Initial Consultation Agreement

The Initial Consultation Agreement sets forth the terms and conditions of the initial consultation meeting between THOMAS LAW FIRM PLLC (“we” or “us”) and the undersigned prospective client(s) (“you”):


  1. Purpose. The purpose of the initial consultation is for us

    (a) to learn about you and your particular legal needs based on the information you provide;

    (b) to answer your questions to the best of our ability;

    (c) to identify your options and, to the extent possible, analyze the costs and benefits to those alternatives;

    (d) to help you determine your course of action, if any;

    (e) to discuss our fees and the terms of our representation if an attorney-client relationship is to be established after this meeting; and

    (f) to determine the next steps, as appropriate.


  1. Confidentiality. All information and documents that you provide at the initial consultation shall remain strictly confidential, whether or not you decide to retain THOMAS LAW FIRM PLLC to provide legal services, except as authorized by you or otherwise provided under the Florida Rules of Professional Conduct.


  1. Ex-Parte Communication: Our clients are prohibited from any direct communication with opposing counsel and between the court (and Judge’s assistant), under Florida law. The purpose behind prohibiting ex-parte communications is to ensure that the litigants in a proceeding have a neutral forum and an impartial judge. Our clients must not contact opposing counsel or the Judge directly.


  2. Reliance Limited. In some instances, it may be impossible to fully assess a matter within the time frame allotted for the initial consultation or with the information or documents that you provide at the initial consultation, you should not rely upon any legal opinions provided by us during the initial consultation concerning any legal matter.


  3. Limited Scope. No attorney-client relationship is intended to be established by the initial consultation. The initial consultation is a limited scope service provided by the THOMAS LAW FIRM PLLC to help you determine whether you may want to retain us to provide you legal services. At the conclusion of the initial consultation, there will be no obligation for you to retain the us, nor do we have an obligation to provide any services to you, unless mutually agreed by both parties.


  4. Engagement Agreement Required. Following the initial consultation, if you agree to retain us, and if we agree to provide services to you, then we will prepare a separate and more detail agreement to be executed by both parties. The new Retainer Agreement will supersede this Initial Consultation Agreement and will set forth the terms and conditions of our representation of you, including our fees and the specific services to be performed by us.


  5. Cost of Initial Consultation. The first 60 minutes of the initial consultation are provided for a discounted rate of $400.00. Payment of these charges must be made before the initial consultation meeting. If the initial consultation lasts longer than 60 minutes, there will be a charge for additional meeting time at a rate of $50.00 for each fifteen (15) minute increment. Payment of these charges must be made at the conclusion of the initial consultation meeting.


  6. Refunds and Questions: Please let us know if you have any questions about the documents needed for your appointment, or if you need to change the time or date of your appointment.  Please be aware that as of January 1, 2022 the initial consultation fee is non-refundable. If you are unable to make your appointment, please let us know as soon as possible to ensure that you are not preventing the opportunity for another potential client to speak with the Attorney. You may transfer your consult fee to another day and be honored for 12 calendar months from the date you initially booked.

By signing this document below, I agree to the terms and conditions set forth above concerning my initial consultation meeting, and I understand that this meeting is limited in scope and will not establish an attorney- client relationship with THOMAS LAW FIRM, PLLC.
